Phoebe Lake, daughter of Nicholas Lake, married a John Smith so I needed to know more about Nicholas Lake to help identify which John Smith she married. It is my conclusion that Phoebe Lake married John Smith, the son of James Smith Esq, who first settled at the mouth of the Trent River. See the argument more fully developed in section 9 of the above web page on James Smith Esq. In 1797 Nicholas petitions that he has 10 children and interestingly all ten survived to adulthood and petitioned as sons and daughters of the loyalist. They are identified below with transcriptions of the records found so far. More contemporary records are welcome - send them along if you wish. 1. OVERVIEW Nicholas Lake is identified in a number of on line lineages as being born on 18 May 1755, White Creek, Rensselaer Co., New York and he married Rhody Broodwell. Another on line source says he was born 1750 in Sommerset, NJ and his parents were John Lake and Margaret Snyder. There seems to be agreement that he married Rhody or Rhonda Broodwell or Bradwell. This researcher has not seen contemporary records to support these assertions. In Nicholas's two petitions he states that he joined in 1777 under General Burgoyne, employed in intelligence and was taken prisoner after Burgoyne's defeat. He also states that he was a private in Col Eatons Regiment. In 1797 he declares that he has a wife and ten children, 3 are boys and the youngest is 3, with one married. In the various petitions of his children it is stated that he first settled in Ernestown and then later in Sidney Township. A few also declare that he was "late of Thurlow" at the end of his life. The Aug 1803 petition of his daughter Hannah states that Nicholas is deceased. This is the earliest record determining his death to be before Aug 1803. 2. NICHOLAS LAKE RECORDS PETITION 1790 The memorial of Nicholas Lake, late private in Colonel Eatons Regiment, humbly Sheweth, That your Lordships memorialist has received 200 acres of land under the Instructions of 1783 & having duly improved the same, Humbly prays that his Lordship's Bounty of 200 cares may be assigned him in the Eighth Townshp. PLBQ In the Pioneer Life on the Bay of Quinte it is stated that John Longwell, b 1757, "married Margaret, daughter of John Lake, a pioneer." Source: PLBQ, p. 507 MARRIAGE 48. BURIAL A headstone in the Longwell Cemetery reads, "John Longwell U.E.L, 1757-1841, His wife, Margaret Lake U.E.L, 1760-1847" Brain Lake sent a photo of this headstone and concludes that "Margaret could not be a child of Nicholas and Rhody" if she was born in 1760 and Nicholas was born c1755. However Margaret does clearly petition as a daughter of Nicholas Lake. Perhaps the birth date on the headstone is incorrect. Brian goes on to write that, "I am not sure where I got the info but I have Margaret born 1773 and died in 1847." That sounds more reasonable. In 1808 she is named as Phebe. It is my contention that Polly is an error and his wife was Phebe all along. At 24 in 1803 she would be born about 1779. Doug Smith, a descendant of Richard Smith, wrote in March 2017 that, "I recently submitted my DNA to Ancestry and got this match to a Lake descendant. I know we have not had proof such as a marriage document for Richard and Elizabeth, but possibly this DNA link is proof enough." This is excellent support for Richard Smith and Elizabeth Lake to be the above couple. 4. Hannah Lake PETITION 1803 Sydney 13 Aug 1803 The petition of Hannah Hagerman, wife of John Hagerman of the Township of Sydney and daughter of the late Nicholas Lake of Sydney, a UE Loyalist. Your petitioner is of age and married and has never received any lands ... prays for 200 acres. [fold] Read 26 June 1797, Recommended for 200 acres, 28 June in Council, Warrant issued on the fathers? petition bundle H2 No 77 HAGERMAN The Hagerman name is well known in the early record as Nicholas Hagerman was the first lawyer in the Midland District and his son Christopher was a judge as well. In checking PLBQ [431-35] there is no indication of how this John Hagerman fits into the family. From my notes: NICHOLAS LAKE BIRTH: asumed to be oldest son of John Lake and Margaret Snider per a petition filed in 1850 by Nicholas Lake of Rawdon, who is identified in the petition as being the grandson of "Nicholas Lake, eldest brother of Mary Lake Parrott". Birth date c1750 assumed from known birth dates of his brothers and sisters. MARR: There are several men named "Nicholas Lake" that appear to be contemporaries. This Nicholas is assumed to be the same one who married Rhody Broadwell/Broodwell. This assumption is based on comparing names in the baptismal records of the children of Nicholas Lake and Rhody Broodwell from the Schaghticoke DRC, Albany & Rennselaer Cos. with UEL land petitions from Ontario Canada. Not known if Rhody Broadwell/Broodwell is the mother of all 10 children or if there were other marriages. CHILDREN: Margaret, bp 9 Jan 1773; Phoebe, bp 3 Sep 1775; Elizabeth, bp 10 May 1777; Richard, bp 12 Jun 1779; Mary, bp 12 Jul 1781; Hannah, 2 Aug 1782; Sarah, b. bef 1782; John, b. c1786; Letty, b. c1790; James, b. c1794. Age of Sarah is unknown but she must have been old enough to have been married by 1797 since Nicholas says that seven of his children are of lawful age and married. LAND: "Loyalist Settlements 1783-89, New Evidence of Loyalist Claims" by W. Bruce Antliff, pb 1985, pg 339: "27 Feb 1788 Nicholas Lake, late of Cambridge - Albany County...sent claim to Capt Covell...dated Dec 1783...native of NJ...joined Burgoyne at Skeensborough and remained with him until the Convention...then he returned home...he came to St. Johns and staid 3 days and returned...now come to settle...turned out with the Militia during the time he remained and went against Ft. Edward. Witness was uncle, Thomas Lake...says he was taken prisoner. 3 Mar 1788 Witness - Capt Justus Sherwood says claiment joined his company in 1777...he was desired to stay in the Country...for intelligence." This evidence of a claim was crossed out and claim was most probably rejected. The similarity of these claims, combined with the witness Thomas Lake being named "uncle to claiment", the baptismal records from Schaghticoke naming children of Nicholas Lake and Rhody Broadwell being the same names found in UEL petitions claiming to be "son/daughter of Nicholas Lake, UEL", and the children named in the "Sherwood Account Book" cited on pg 242 of McMillan's "Hist of My People and Yours", all seem to provide consistent evidence to the identify of this Nicholas Lake. Further evidence is found in a petition filed in 1850 by Nicholas Lake of Rawdon who is identified in the petition as being the grandson of "Nicholas Lake, eldest brother of Mary Lake Parrott". (claim ref below.) There is another claim dated 15 Dec 1790, "L" Bundle Misc 1788-95, "Nicholas Lake, late private in Col. Jessup's Reg...has received two hundred acres of land...and having duly improved the same...prays...200 acres may be assigned him in the Eighth township." Not clear if this was recommended or rejected but it would appear that the petition "read 11 Nov 1797" seemed to satisfy all claims. According to John Collins Clark, son of Robert Clark, the first lots were taken up in the following order, commencing at the easternmost lot, No. 42: Lot 42 was first occupied by David Purdy; Joshua Booth, Esq., married to a daughter of David Fraser, lived on Lot 40 or 41; Mr. Nicholas Lake, Lot 39, but soon left it. 11 Jun 1797 - Petition of Nicholas Lake, dated Jun 1797 reads in part "served in 1777 under Burgoyne...taken prisoner...upon release, called to aid and assist His Majestys [secret service implied]...at Little White Creek...has a large family. ..wife and ten children, three of which is boys, youngest is three years of age the rest is seven of Lawful age and are married..." (ltr from Charles Lake of Foxboro to BLNoyes, film , pg 132.) DEATH: A Petition filed by Richard Lake 27 Jan 1807 refers to Nicholas as "deceased. Petitions and affidavits filed in 1850 to claim the UEL grant of Mary Lake Parrott (200 acres, Lot 27, 1st Conc. Otanabee) state that Nicholas was the eldest son of John Lake of Ernestown, and died about "40 years hence". (Refer to notes of Mary Lake Parrott.) NOTE: "Old Cambridge District", A.D. Due to the numerous "Nicholas Lake"s, it is not clear whether or not this account applies to the son of John Lake, but given the information provided in his land claims, it would seem to be possible. Let me just give my opinion regarding the confusion about these particular Nicholas Lakes. There had been a lot of misinformation regarding Nicholas Lake, son of John Lake and Margaret Snyder. This was generated by a lot of speculation on the part of Claud McMillan in his book about this Lake family. There's a lot of great stuff in his book but there is also vast amounts of error so you have to really be careful using his book. The petition and affidavits dated 27 Aug 1850 filed by Nicholas Lake of Rawdon, son of Richard Lake of Rawdon have clarified the identity of Nicholas, son of John Lake and Margaret Snyder. Apparently there was some family squabbling over who had the right to inherit Mary Lake Parrott's property after the death of her husband, James Parrott. Nicholas Lake (of the 1850 petition) is seeking the right to 200 acres granted Mary in the township of Otanabee, Lot 27, lst Concession. The right to this lot was left in James Parrott's will to "John and James Lake, sons of the late Nicholas Lake, deceased..." Apparently, this lot was originally granted to Mary as a daughter of UEL, but then "cancelled" and in 1830 granted anew to a Mr. L. Burnham. James Lake of Sidney also files a petition, 28 Feb 1850 stating "together with his brother John Lake, now deceased, was devised (in James Parrott's will)...Lot 27, 1st Otanabee." James is seeking "satisfaction". On 5 Aug 1850, James Lake, Jr. of Sidney "son and heir of the late John Lake of Sidney" is also making claim for the right to "one half of Lot 27", challenging his uncle James' "sole claim to said Lot..prays...to consider the claim...and grant him his just right." 1 Aug 1851 - "The Commitee recommended that the written suggestion of the Commissioner of Crown Land be approved and carried into effect. 4 Aug 1851, Approved in Council. Petitioner, (Nicholas Lake) represents that Mary Perrott, wife of James Perrott, who was entitled to 200 acres of land as the daughter of John Lake, UE Loyalist, died without issue and that he is her heir at law and entitled to this...that the eldest son of John Lake, UE Loyalist was Nicholas Lake of Sidney who died about 40 years since, that his eldest son was Richard Lake of Rawdon who died in the year 1817 and that Nicholas Lake of Rawdon is his only son...It will be observed on reference to the Petition of James Lake of Sidney who it appears is a brother of this applicants Father and with him a son (note: this should have read "grandson", referring to James Lake, Jr, heir of the "late John Lake") of Nicholas Lake the brother of Mary Perrott that he claims the UE Right in question under a bequest in the Will of James Perrott. (as a side note, this petition specifically states that Mary Lake Parrott and James Parrott died without issue. McMillan also got this wrong by naming a Jonathan and James Parrott as their children.) The info in these petitions, combined with the UEL petitions of the children of Nicholas Lake, compared to the baptismal records from the Schagticoke DRC clearly identifies Nicholas Lake, who was married to Rhoda Broadwell as the son of John Lake and Margaret Snyder. He did not have a wife, Mary. There is no will, as stated in error by McMillan, naming a wife named Mary. This is speculation by McMillan, based on a lack of information and confusing the son of John Lake with his grandfather, Nicholas Lake Sr of NJ. (By the way, McMillan also states that the name of Mary, wife of Nicholas Lake, Sr is unknown. This is also an error as she was Mary Johnson, dau of Hendrick Janszen/Johnson and Maria Mynderts, named in their will dated 15 Dec 1746, wp 7 Aug 1762 (NY Wills, Vol VI:166). John Lake and Margaret Snyder had another son, John Lake Jr. who was b. c1759. This John Lake, Jr. had a number of children who are named in a an affidavit from Daniel Fraser dated 24 Apr 1844 which was written to help restore John Lake Jr's name to the UEL list. One of those children was also named Nicholas Lake, b. c1799. It is thought that he is the one who was married to Catherine Hartman. Since Catherine Hartman, dau of Loderick Hartman received a grant of land 8 Nov 1836, it appears from the dates that this makes sense for her to have been married to the younger Nicholas, not the one who died about 1807. She is the daughter of Nicholas Lake born in Somerst New Jersey. Married John Sine in 1812. Letty was granted 200 acres of land in Burgess Township in 1812, she being the daughter of the late Nicholas Lake of Sidney, a United Empire Loyalist formerly of Earnsestown.There is no record of her ever having occupying it. If anyone has any ideas about the whereabouts of Letty please respond. It is possible that John Sine died and she went on to marry another. We believe they married in Ontario, Canada before January 15, 1812 when Letty petitioned for land from the government as the daughter of Nicholas Lake U.E. Letty was the daughter of Nicholas and Mary Broadwell/Bradwell from Somerset Co. New Jersey.
