Lake, Jacob Lake, and Anthony Pool from Schooley's Mountain went to Hackettstown to drink with the "town boys" and ended up in a scuffle with them. Jesse Niper threatened to throw Thomas into the river and Thomas drew his knife and stabbed Jesse, inflicting a mortal wound. The three "mountain boys" were arrested and jailed in Morristown until Judge Linaberry freed them about two weeks later and labeled the incident a "justifiable homicide." Thomas J. Lake, Jacob Lake and Anthony Pool visited the town, drank with a company of young men of that place, who followed and bantered the visitors when they left. Jesse Niper seized Thomas J. Lake and threatened to throw him in an adjacent stream, when Lake drew a knife and inflicted a mortal wound upon Niper. The three were sent to Morristown jail by Justice Linebury, though the intoxicating effects of their potations had been aggravated by the tauntings of the town boys.
