Between Archer Gifford, et. al. } Ex'r. of Andrew Bell, dec'd. } Complainants: } On bill to foreclose. AND Jacob Tiger, and Abraham } Tiger, et. al. } Defendants. } IT appearing to this Court that the complainants have filed their bill in the above cause against Abraham Tiger, Jacob Tiger, John Tiger, Christopher Tiger, Nicholas Tiger, George Tiger, George Eick and Mary [Eick] his wife, Jacob Eick and Sarah [Eick] his wife, David Bess, Andrew Bess, jr., George Bess, Nathaniel Bess, Conrad Lindabery and Ann [Lindabery] his wife, John McWilliams, Catharine McWilliams, Lydia Ann McWilliams, Sarah Ellen McWilliams, Julia Ann McWilliams, Joseph McWilliams, William Gibson, John Mooney and Sarah [Mooney] his wife, and Jacob Tiger; and that process of subpoena to appear and answer, directed to the defendants hath been regularly issued, returnable to the Thirtieth day of January last; but that the defendant Nicholas Tiger could not be found in this State, to be served therewith, and Nicholas Tiger hath not caused his appearance to be entered as in case such process had been duly served, and it being made to appear by affidavit to the satisfaction of the Chancellor, that the said Nicholas Tiger is not at this time resident in the state of New Jersey; but that he has moved to the state of Ohio. It is thereupon, on Second day of February, in the year of our Lord one thousand eight hundred and forty-four, on motion of J. [James] N. Reading, solicitor of the complainant by this order directed by the Chancellor, that the said absent defendant Nicholas Tiger appear, plead, answer or demur, to the complainant's bill, on or before the Second day of April next, or that in default thereof, such decree be made against him as the Chancellor shall think equitable and just. And it is further ordered, That this order shall, within twenty days hereafter, be served personally on the said Nicholas Tiger, by a delivery of a copy thereof to him, or be published within the said twenty days in the Hunterdon Gazette, a newspaper printed at Flemington, in this State, and continued therein for six weeks successively, at least once in every week.
