Between John S. Lake of the City of Trenton, County of Mercer and State of New Jersey and Letitia Lake his wife party of the first part, and Jared Hoyt of the City of Trenton in the County of Mercer, and State of New Jersey, party of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of One thousand and fifty dollars lawful money of the United States, to them the said party of the first part, in hand well and truly paid by the said party of the second part, before the sealing and delivery of these presents, the receipt whereof the said party of the first part, doth hereby acknowledge, have [given EDITORS NOTE: this word was written and crossed out] granted, bargained, sold, aliened, released conveyed and confirmed, and by these presents doth grant, bargain, sell, alien, release, convey and confirm, unto the said party of the second part, his heirs and assigns all that certain Brick House and Lot of Land situated in Warren (or Bloomsbury) street in the fourth ward of the City of Trenton in the County of Mercer, and State of New Jersey, being in a plan of Lots of William Griffith Called Lot No 8 – Fronting or in with twenty five feet, on the westerly side of said street and extending from thence at right angles thereto westerly the same width by and between Lot No 7 now belonging to Septemons Weatherley on the Northerly side thereof, and lot No 9 now belonging to Charles W. Sutterly on the Southerly side thereof One hundred and eighteen feet to an Alley, being the same house & lot that James Ewing of the City of Trenton aforesaid sold and conveyed to Letitia Schenck (now wife of the said John S Lake) by deed bearing date the twenty eighth day of December in the year of our Lord one thousand eight hundred and thirty nine. And recorded in the Clerks office of the County of Mercer in Book B of Deeds folia 266 & 267, as by reference to the same will appear. Together with all and singular, the building, improvements ways, woods, waters, water courses, rights, liberties privileges, hereditaments and appurtenances, to the same belonging or in any wise appertaining; and the reversion, and reversions, remainder, and remainders, rents issues and profits thereof, and every part and parcel thereof, and also, all the estate right title interest use possession property claim and demand whatsoever both in law and equity of them, the said party of the first part, if in and to the said premises, with the appurtenances. To have and to hold the said house and Lot of Land, hereditaments and premises hereby granted and every part and parcel thereof, with the appurtenances unto the said party of the second part, his heirs and assigns to the only proper use, benefit and behoof of him the said party of the second part his heirs and assigns forever. And the said John S. Lake and Letitia his wife party aforesaid of the first part, for themselves their heirs executors, and administrators do hereby covenant promise and grant to and with the said Jared Hoyt party of the second part, his heirs and assigns, that at the time of the sealing and delivery hereof, they the said party of the first part were seized in their own right of an absolute and indefeasible estate of inheritance in fee simple, of and in all and singular the premises hereby granted, with the appurtenances, and have good, right, full power, and sufficient authority in the Law to grant, bargain sell and convey the same unto the said party of the second part, his heirs and assigns forever, according to the true intent and meaning of these presents. And also, that it shall and may be lawful for the said party of the second part his heirs and assigns at all times forever hereafter, peaceably and quietly to have hold use occupy possess and enjoy the said premises with the appurtenances and every part and parcel thereof without the lawful let suit eviction interruption or disturbance of the said party of the first part their heirs or assigns, or any other person or persons whomsoever lawfully claiming or to claim the same; and that the said premises are free and clear and freely and clearly acquitted and discharged of and from all former mortgages Judgments executions and of and from all other incumbrances whatever. And Lastly that they the said party of the first part, and their heirs all and singular the House and Lot of Land hereditaments and premises hereby granted with the appurtenances, unto the said party of the second part, his heirs and assigns, against them the said party of the first and their heirs and against all and every other person and persons whomsoever lawfully claiming or to claim the same shall and will warrant and forever defend. Smith a Commissioner of the County of Mercer and State of New Jersey, to take the acknowledgement and proof of Deeds personally appeared John S. Lack of the City of Trenton, County and State aforesaid and Letitia Lake his wife who are I am satisfied the grantors mentioned in the foregoing deed of conveyance and the contents thereof being by me first made known unto them they did thereupon acknowledge that they signed sealed and delivered the same as their voluntary act and deed for the uses and purposes therein expressed. And the said Letitia Lake on a private examination before me separate and apart from her said husband acknowledged that she signed, sealed, and delivered the same, as her voluntary act and deed, freely, without any fear, threats, or compulsion of her said husband.
