Family Search Mercer County, New Jersey Grantor Deeds, Volume V, 1851-1852 Page 327-328 Film #825484 DGS #8210917 Image 200-201 John S Lake & wife To John Whittaker This Indenture made this thirteenth day of December in the year of our Lord one thousand eight hundred and fifty one Between John S Lake of the City of Trenton and State of New Jersey and Letitia his wife party of the first part and John Whittaker of the same place party of the second part Witnesseth that the said party of the first part for and in consideration of the sum of one Thousand dollars lawful money of the United States to them the said party of the first part in hand well and truly paid by the said party of the second part before the sealing and delivery of these presents, the receipt whereof the said party of the first part do hereby acknowledge have granted bargained, sold, aliened released conveyed and confirmed; and by these presents do grant bargain sell alien release, convey and confirm, unto the said party of the second part his heirs and assigns. All that certain Frame tavern house and Lot of Land situate in the township of Nottingham County of Mercer and State aforesaid bounded and described as follows: Beginning at the North Westerly corner of lot number seventy eight on Coates plan of lots and thence South Easterly by Landing Street forty feet thence (2) Northeasterly, at right angles with Landing Street one hundred and twenty five feet to Race Street, thence Northwesterly by Race Street forty feet; thence at right angles with Race Street Southwesterly One Hundred and twenty five feet to the place of Beginning – being part of the lot number seventy eight as laid down on said map and the said lot conveyed to John S Lake by George M Coates and Rebecca his wife and Benjamin Coates of the City of Philadelphia State of Pennsylvania by Deed bearing date the twenty second day of October in the year of our AD One thousand Eight hundred and forty seven Together with all and Singular the buildings, improvements ways, woods, waters, water courses rights liberties privileges hereditaments and appurtenances to the same belonging or in any wise appertaining; and the reversion and reversions, remainder and remainders, rents issues and profits thereof, and of every part and parcel thereof; and also all the estate, right title interest, use possession property claim and demand whatsoever, both in law and equity of them the said party of the first part of in and to the said premises with the appurtenances To Have and To Hold the said House and lot of land the hereditaments and premises hereby granted and every part and parcel thereof with the appurtenances, unto the said party of the second part his heirs and assigns to the only proper use benefit and behoof of them the said party of the second part their heirs and assigns forever: And the said John S Lake and Letitia his wife party aforesaid of the first part for themselves their heirs executors and administrators, do hereby covenant promise and grant to and with the said John Whittaker party of the second part his heirs and assigns – That at the time of the sealing and delivery hereof they the said party of the first part are seized in their own right of an absolute and indefeasible estate of inheritance in fee simple of and in all and singular the premises hereby granted with the appurtenances, and have good right full power and sufficient authority in the law to grant, bargain, sell and convey the same unto the said party of the second part, his heirs and assigns forever according to the true intent and meaning of these presents. And Also that it shall and may be lawful for the said party of the second part his heirs and assigns at all times forever hereafter peaceably and quietly to have, hold, use occupy possess and enjoy the said premises with the appurtenances and every part and parcel thereof, without the lawful let suit eviction interruption or disturbance of the said party of the first part their heirs or assigns, or any other person or persons whomsoever lawfully claiming or to claim the same: And that the said premises are free and clear, and freely and clearly acquitted and discharged of and from all former mortgages judgements executions and of and from all other incumbrances whatever – And lastly, that they the said party of the first part and their heirs all and singular the said house and lot of land with the hereditaments and premises hereby granted with the appurtenances unto the said party of the second part his heirs and assigns against them the said party of the first part and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same shall and will warrant and forever defend – In witness whereof the said party of the first part have hereunto set their hands and seals the day and year first above written John S Lake his mark (seal) & Letitia Lake (seal) Signed sealed and delivered in the presence of B Hendry State of New Jersey Camden County ss Be it know that on the fifteenth day of December in the year of our Lord one thousand eight hundred and fifty one before me the subscriber a Commissioner for taking the acknowledgement & proof of deeds for the County of Camden and State of New Jersey personally appeared John S Lake and Letitia his wife who are I am satisfied the grantors mentioned in the foregoing Deed of Conveyance and the contents thereof being by me first made known unto them they did thereupon acknowledge that they signed sealed and delivered the same as their voluntary act and deed for the uses and purposes therein expressed. And the said Letitia on a private examination apart from her husband by me did acknowledge that she signed sealed and delivered the same as her own voluntary act and deed without any fear threats or act of compulsion on the part of her said husband B Hendry Commissioner Recorded December 20th 1851
