Lake & wife To Henry Evernham This Indenture made this twenty sixth day of January in the year of our Lord Four thousand eight hundred and forty seven Between John S. Lake and Susanna his wife of the Borough of South Trenton County of Mercer and state of New Jersey party of the first part and Henry Evernham of the township of Upper Freehold Monmouth County and state of New Jersey aforesaid party of the second part – Witnesseth that the said party of the first part for and in consideration of the sum of six hundred and fifty dollars lawful money of the United States to them the said party of the first part in hand well and truly paid by the said party of the second part before the sealing and delivery of these presents the receipt whereof the said party of the first part do hereby acknowledge have granted bargained sold aliened released conveyed and confirmed and by these presents do grant bargain sell alien release convey and confirm unto the said party of the second part his heirs and assigns all that certain house and lot of land situate lying and being on the east side of Union street in the Borough of South Trenton aforesaid Beginning fronting or in width twenty feet (on the east side of Union street aforesaid and from thence extending at right angles thereto north eighty nine degrees east the same width (twenty feet) by a lot late of Benjamin Fish now John S. Lake on the north side thereof and extending one hundred and fifty feet back to an alley or land of Philemon Dickerson being the same lot conveyed by “The Camden and Amboy Rail Road and Transportation Company” to the said John S. Lake by deed bearing date the first day of April eighteen hundred and forty one and recorded in the Clerk’s office of the County of Mercer book C of Deeds folias 571 and 572 Together with all and singular the buildings improvements ways woods waters water courses rights liberties privileges hereditaments and appurtenances to the same belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and of every part and parcel thereof and also all the estate right title interest use possession property claim and demand whatsoever both in law and equity of him the said party of the first part of in and to the said premises with the appurtenances To have and to hold the said house and lot of land hereditaments and premises hereby granted and every part and parcel thereof with the appurtenances unto the said party of the second part his heirs and assigns to the only proper use benefit and behoof of him the said party of the second part his heirs and assigns forever and the said John S. Lake party aforesaid of the first part for himself his heirs executors and administrators doth hereby covenant promise and grant to and with the said Henry Evernham party of the second part his heirs and assigns That at the time of the sealing and delivery hereof be the said party of the first part is seized in his own right of an absolute and indefeasible estate of inheritance in fee simple of and in all and singular the premises hereby granted with the appurtenances and both good right full power and sufficient authority in the law to grant bargain sell and convey the same unto the said party of the second part his heirs and assigns forever according to the true intent and meaning of these presents And also that it shall and may be lawful for the said party of the second part his heirs and assigns at all times forever hereafter peaceably and quietly to have hold use occupy possess and enjoy the said premises with the appurtenances and every part and parcel thereof without the lawful let suit eviction interruption or disturbance of the said party of the first part his heirs or assigns or any other person or persons whomsoever lawfully claiming or to claim the same And that the said premises are free and clear and freely and clearly acquitted and discharged of and from all forever mortgages judgements executions and of and from all other incumbrances whatever And lastly that the said party of the first part and his heirs all and singular the said house and lot of land hereditaments and premises hereby granted with the appurtenances unto the said party of the second part his heirs and assigns against him the said party of the first part and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same shall and will warrant and forever defend In witness whereof the said party of the first part have hereunto set their hands and seals the day and year first above written his her John S x Lake (seal) Susanna x Lake (seal) mark mark signed sealed and delivered in the presence of Eli Morris State of New Jersey Mercer County ss Be it known that on the thirteenth day of February in the year of our Lord one thousand eight hundred and forty seven before me Eli Morris a Commissioner for taking the acknowledgment and proof of Deeds in and for the County of Mercer aforesaid personally appeared John S. Lake and Susanna his wife who are I am satisfied the grantors mentioned in the foregoing Deed of Conveyance and the contents thereof being by me first made known unto them they did thereupon acknowledge that they signed sealed and delivered the same as their voluntary act and deed for the uses and purposes therein expressed And the said Susanna Lake being by me privately examined separate and apart from her said husband acknowledged that she signed sealed and delivered the same freely without any fear threats or compulsion of her said husband Eli Morris Commissioner Recorded June 19th 1847
